Unemployment insurance also known as unemployment benefits is a state/federal program that provides cash benefits to eligible workers. Each state has a separate unemployment insurance program, but all states follow the same guidelines.

Unemployment insurance (benefits) are intended to provide temporary financial assistance to unemployed workers who are unemployed by forces outside of their control. Some of these forces include; you were laid off because of lack of work, your hours were cut back because of lack of work, you were fired without good cause, you quit your job with good cause, for example, unhealthy or dangerous working conditions, you had to leave your job because of domestic violence or you were forced to quit your job because of a very important personal reason.

In general, unemployment insurance benefits are based on a percentage of your earnings over a recent 52-week period, and each state sets a maximum amount. Unemployment insurance is subject to federal and most state income taxes and must be reported on your income tax return. A general rule is that all determinations of whether or not a person is eligible for unemployment insurance benefits are made by the appropriate State laws.

A few reasons that could make you ineligible to qualify for unemployment benefits include; you quit because you did not get along with coworkers, you were fired because you did something wrong on purpose, you lost your job because you were convicted of a misdemeanor or felony, or you are not currently looking for a new job.

If you are disqualified/denied benefits, you have the right to file an appeal and you must file your appeal within an established time frame. Your employer may also appeal a determination if he/she does not agree with the State’s determination regarding your eligibility. When you file a claim, you will be asked for certain information, such as addresses and dates of your former employer so be sure to give complete and correct information.

It generally takes two to three weeks after you file your claim to receive your first unemployment insurance check. If you have any questions regarding your eligibility for unemployment insurance contact the Goldbach Law Group, we can help!
